BloomEditor provides a modern WYSIWYG (What You See Is What You Get) editor for web applications. Our Services include:

  • Regular updates and feature improvements

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice.

3. Registration & Accounts

  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access

We reserve the right to suspend or terminate your account if any information provided during registration proves to be inaccurate, false, or misleading.

4. Subscriptions & Payments

4.1 Subscription Plans

BloomEditor offers various subscription plans, including Free, Basic, Business, and Enterprise tiers. Each plan has specific features, limitations, and pricing as described on our website.

4.2 Billing & Renewal

Paid subscriptions automatically renew at the end of each billing cycle unless canceled before the renewal date. You authorize us to charge the applicable subscription fees to your designated payment method.

4.3 Payment Terms

All fees are exclusive of taxes, which we will charge as applicable. You are responsible for paying all taxes associated with your subscription.

4.4 Refund Policy

Subscription fees are non-refundable, except as required by law or as specifically stated in our refund policy. We may consider refund requests on a case-by-case basis.

Free Trial

We may offer free trials for certain subscription plans. You may be required to cancel before the trial period ends to avoid being charged.

5. Usage Rights & Restrictions

5.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use our Services for your internal business purposes.

5.2 Usage Restrictions

You agree not to:

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you own or have the necessary rights to all User Content you submit.

6.3 Prohibited Content

You may not use our Services to create, store, or transmit content that:

  • Is illegal, harmful, or promotes illegal activities
  • Infringes upon intellectual property rights
  • Contains viruses or malicious code

10.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. We may permanently delete your User Content after a reasonable period following termination.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services are free of viruses or other harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BLOOMEDITOR, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless BloomEditor and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of and access to the Services
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including any copyright, property, or privacy right
  • Any claim that your User Content caused damage to a third party

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration in Delaware, rather than in court, except that you may assert claims in small claims court if your claims qualify.

14.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. You may not bring a claim as a plaintiff or class member in a class or representative action.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.
